SIBSIB Karaoke - ซิบซิบ คาราโอเกะ

กรุณาอ่านข้อตกลงนี้อย่างละเอียดก่อนใช้งานซอฟต์แวร์ การที่คุณติดตั้ง ใช้งาน หรือเข้าถึงระบบของ SIBSIB Karaoke ถือว่าคุณยอมรับเงื่อนไขทั้งหมดในข้อตกลงนี้ หากคุณไม่ยอมรับเงื่อนไข กรุณายุติการใช้งานและลบซอฟต์แวร์ออกจากอุปกรณ์ของคุณทันที

1. การอนุญาตให้ใช้สิทธิ์ (License Grant)

• ผู้พัฒนาอนุญาตให้คุณใช้สิทธิ์ซอฟต์แวร์นี้ในลักษณะส่วนบุคคลและไม่สามารถโอนสิทธิ์ให้ผู้อื่นได้ (Non-transferable) ข้อตกลงนี้มีผลบังคับใช้กับซอฟต์แวร์ SIBSIB Karaoke ทุกรุ่น ไม่ว่าจะเป็นรุ่นใช้งานฟรี (Free Edition) หรือรุ่นแบบมีค่าใช้จ่าย (Pro Edition)
• สิทธิ์การใช้งานของคุณจะถูกผูกติดกับรหัสประจำตัวฮาร์ดแวร์ของเครื่องคอมพิวเตอร์ (HWID) หรือ อุปกรณ์ฮาร์ดล็อค (Hardlock) ที่ได้ลงทะเบียนไว้ (ขึ้นอยู่กับรุ่นที่คุณใช้งาน) ไม่สามารถนำสิทธิ์ดังกล่าวไปใช้ซ้ำซ้อนกับอุปกรณ์อื่นที่ไม่ได้ลงทะเบียนในเวลาเดียวกัน

2. ข้อจำกัดและข้อห้าม (Restrictions)
ผู้ใช้ตกลงที่จะ ไม่กระทำการ ดังต่อไปนี้:

• ทำวิศวกรรมย้อนกลับ (Reverse Engineer) ถอดรหัส แยกส่วนประกอบ หรือพยายามเข้าถึงซอร์สโค้ดของซอฟต์แวร์
• พยายามหลีกเลี่ยง ดัดแปลง ปลอมแปลง หรือทำลายระบบรักษาความปลอดภัย ระบบตรวจสอบสิทธิ์ (Hardlock / HWID) หรือระบบเชื่อมต่อฐานข้อมูลของซอฟต์แวร์
• คัดลอก แจกจ่าย ให้เช่า หรือนำซอฟต์แวร์ไปจำหน่ายต่อโดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรจากผู้พัฒนา
• นำซอฟต์แวร์ไปใช้ในทางที่ผิดกฎหมาย หรือนำไปใช้เพื่อการละเมิดลิขสิทธิ์เพลงและไฟล์มิดี้ (MIDI) ของบุคคลที่สาม

3. ระบบตรวจสอบสิทธิ์และการระงับการใช้งาน (Authentication & Banning)

• ซอฟต์แวร์อาจมีการเชื่อมต่อกับเซิร์ฟเวอร์ส่วนกลางเพื่อตรวจสอบสิทธิ์การใช้งาน (License Verification) ผู้ใช้ยินยอมให้ระบบจัดเก็บข้อมูลที่จำเป็น เช่น หมายเลข HWID, หมายเลข Hardlock, IP Address และเวอร์ชันของโปรแกรม เพื่อใช้ในการยืนยันตัวตนและความปลอดภัยของระบบ
• สิทธิ์ขาดของผู้พัฒนา: หากระบบตรวจพบความพยายามในการแฮ็ก ดัดแปลงโปรแกรม หรือละเมิดข้อตกลงในหมวดที่ 2 ผู้พัฒนาขอสงวนสิทธิ์ในการ ระงับการใช้งาน (BANNED) หมายเลข HWID หรือ Hardlock ของคุณอย่างถาวรทันที โดยไม่จำเป็นต้องแจ้งให้ทราบล่วงหน้า และจะไม่มีการคืนเงินหรือชดเชยใดๆ ทั้งสิ้นในทุกกรณี
  

4. ทรัพย์สินทางปัญญา (Intellectual Property)

• ซอฟต์แวร์ SIBSIB Karaoke รวมถึงโค้ด อัลกอริทึม ดีไซน์ และฟังก์ชันต่างๆ ถือเป็นทรัพย์สินทางปัญญาของผู้พัฒนาแต่เพียงผู้เดียว การอนุญาตให้ใช้สิทธิ์ไม่ได้หมายความถึงการขายหรือโอนกรรมสิทธิ์ความเป็นเจ้าของซอฟต์แวร์ให้แก่ผู้ใช้

5. การจำกัดความรับผิด (Limitation of Liability)

• ซอฟต์แวร์นี้ให้บริการในลักษณะ "ตามสภาพที่เป็นอยู่" (As Is) ผู้พัฒนาไม่รับประกันความเสียหายใดๆ ที่อาจเกิดขึ้นกับฮาร์ดแวร์ ข้อมูล หรือการสูญเสียรายได้ อันเป็นผลมาจากการใช้งานหรือการไม่สามารถใช้งานซอฟต์แวร์ได้
• ความรับผิดชอบสูงสุดของผู้พัฒนา (สำหรับรุ่นที่มีค่าใช้จ่าย) จะจำกัดอยู่เพียงมูลค่าที่คุณได้จ่ายเพื่อซื้อสิทธิ์การใช้งานซอฟต์แวร์นี้เท่านั้น

6. การอัปเดตและการเปลี่ยนแปลงข้อตกลง

• ผู้พัฒนาขอสงวนสิทธิ์ในการอัปเดตฟีเจอร์ของซอฟต์แวร์ และเปลี่ยนแปลงเงื่อนไขข้อตกลงนี้ได้ตลอดเวลา โดยจะมีการประกาศให้ทราบผ่านช่องทางอย่างเป็นทางการ

Please read this agreement carefully before using the software. By installing, using, or accessing the SIBSIB Karaoke system, you agree to be bound by all the terms of this agreement. If you do not agree to these terms, please discontinue use and remove the software from your device immediately.

1. License Grant

• The Developer grants you a personal, non-transferable license to use the software. This agreement applies to all versions of SIBSIB Karaoke, including both the Free Edition and the Pro Edition.
• Your license is strictly tied to your registered Hardware ID (HWID) or Hardlock device (depending on your software version). This license cannot be used concurrently on any other unregistered devices.

2. Restrictions
You agree NOT to engage in any of the following activities:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software.
• Attempt to bypass, modify, forge, or disable the security systems, authentication mechanisms (Hardlock / HWID), or database connections of the software.
• Copy, distribute, rent, lease, or resell the software without prior written permission from the Developer.
• Use the software for illegal purposes or to infringe upon third-party copyrights, including but not limited to music and MIDI files.

3. Authentication & Banning System

• The software may connect to a central server for License Verification. You consent to the collection of necessary data, including your HWID, Hardlock number, IP Address, and software version, for authentication and security purposes.
• Developer's Absolute Right: If the system detects any attempt to hack, modify the software, or violate any terms in Section 2, the Developer reserves the right to PERMANENTLY BAN your HWID or Hardlock immediately without prior notice. No refunds or compensation will be provided under any circumstances.
  

4. Intellectual Property

• SIBSIB Karaoke, including all its source code, algorithms, designs, and features, is the sole intellectual property of the Developer. This license grants you the right to use the software but does not transfer ownership or any intellectual property rights to you.

5. Limitation of Liability

• This software is provided on an "As Is" basis. The Developer makes no warranties regarding any potential damage to hardware, data loss, or loss of revenue resulting from the use or inability to use the software.
• The Developer's maximum liability (for paid versions) shall be limited strictly to the amount you paid for the software license.

6. Updates and Amendments

• The Developer reserves the right to update software features and amend the terms of this agreement at any time. Any changes will be announced through official channels.
